Concerning
STIPULATION OF TARIFFS OF IMPORT DUTY ON THE IMPORT OF GOODS
IN THE FRAMEWORK OF ASEAN INTEGRATION SYSTEM OF PREFERENCES (AISP)
TO NEW ASEAN MEMBER COUNTRIES (CAMBODIA, LAOS, MYANMAR AND VIETNAM)
THE MINISTER OF FINANCE,
Considering :
- a. that in the framework of narrowing development gap between Cambodia, Laos, Myanmar and Vietnam (CLMV) and ASEAN-6, the scheme of tariffs of import duty on the import of goods in the framework of ASEAN Integration System of Preferences (AISP), expiring on May 25, 2005 has been stipulated on the basis of Decree of the Minister of Finance No. 70/PMK.010/2005 on Stipulation of Tariffs of Import Duty on the Import of Goods in the Framework of f ASEAN Integration System of Preferences (AISP) to New ASEAN Member Countries (Cambodia, Laos, Myanmar and Vietnam);
- b. that since application of the tariffs of import duty in the framework of AISP Scheme is very beneficial to the new ASEAN member countries, the policy needs to be extended;
- c. that based on the considerations as meant in letters a and b, it is necessary to stipulate a regulation of the Minister of Finance on Stipulation of Tariffs of Import Duty on the Import of Goods in the Framework of f ASEAN Integration System of Preferences (AISP) to New ASEAN Member Countries (Cambodia, Laos, Myanmar and Vietnam);
In view of :
- 1. Law No. 10/1995 on Customs Affairs;
- 2. Presidential Decree No. 20/P/2005;
- 3. Decree of the Minister of Finance No. 546/KMK.01/2003 on Stipulation of Tariffs of Import Duty in the Framework of Common Effective Preferential Tariff (CEPT);
- 4. Decree of the Minister of Finance No. 547/KMK.01/2003 on Stipulation of Tariffs of Import Duty on Imported Goods;
Observing :
Letter of the Minister of Trade No. 657/M-DAG/7/2006 dated June 26, 2006.
DECIDES
To stipulate :
THE REGULATION OF THE MINISTER OF FINANCE ON STIPULATION OF TARIFFS OF IMPORT DUTY ON THE IMPORT OF GOODS IN THE FRAMEWORK OF ASEAN INTEGRATION SYSTEM OF PREFERENCES (AISP) TO NEW ASEAN MEMBER COUNTRIES (CAMBODIA, LAOS, MYANMAR AND VIETNAM)
Article 1
The tariffs of import duty on the import of goods from Cambodia, Laos, Myanmar and Vietnam in the framework of ASEAN Integration System of Preferences (AISP) shall be stipulated in the attachment to this regulation.
Article 2
In the case of the generally effective tariff and/ or CEPT being lower than the tariffs of import duty n the basis of this regulation, the lowest tariffs of import duty shall apply.
Article 3
The tariffs of import duty as meant in Articles 1and 2 shall be imposed with the provision as follows :
- 1. Tariffs of Import Duty in the framework of AISP are only applied to the import of goods accompanied by Certificate of Origin (Form D) already signed by the authorized official in the ASEAN Member Countries
- 2. The certificate of origin (Form D) as meant in point 1 is not needed in the case of :
- a. the tariffs of import duty in AISP being the same as the generally effective tariff and/or CEPT;
- b. the import of goods has a customs value not exceeding US$200 (two hundred million US Dollars).
Article 4
With the enforcement of this regulation, the tariffs of import duty as stipulated in the attachment to this regulation shall apply to the import of goods whose Import Declaration (PIB) secured registration number from Customs and Excise Service Offices overseeing importing ports.
Article 5
The Director General of Customs and Excise shall be instructed to implement the provisions in this regulation.
Article 6
The regulation shall be valid for 12 (twelve) months, starting from May 29, 2006.
For public cognizance, the regulation shall be published by placing it in State Gazette of the Republic of Indonesia.
